Phase I & II Investigation

Phase I's is pretty straightforward. It's an investigation of the subject property which must be conducted following ASTM standards which conform to the All Appropriate Inquiry standards, acceptable to the USEPA for provision of certain defenses against CERCLA liability. That's about as clear as mud, right?

 

In layman's terms, it's an investigation of your property by a trained professional who must meet certain professional qualifications, known as an "environmental professional". That's right, not just anyone can do a Phase I.

 

It covers an investigation of the current and past history and uses of the property in question. What was previously on the site? What could past usage have done? Did any usage contaminate the soil or groundwater underlying the site? How about the current operation? Are any petroleum, hazardous materials or chemicals in use at the site, or have they been released to the air, soil or groundwater at or near the site?

It's an investigation to determine if there are any conditions that are indicative of releases of petroleum or hazardous materials or chemicals at the site, now or in the past. These conditions are collectively known as "REC" or recognized environmental conditions. So really, a Phase I is meant to identify REC at the subject property, either at present or which may have been present in the past.

The inspection process is your opportunity to secure property without the fear of losing it to another buyer as you do your due diligence to make sure you are NOT buying a giant sink hole. Boundary Surverying 

Surveys are really important from the very beginning. A property listed and the description being offered by the seller is not always the most accurate. Becoming new neighbors with someone that doesn’t fully agree with the current survey only leads to legal problems in the future.

 

Here are some of the issues we will approach and survey: Boundary Line, Gores, overlaps, gaps, Rights of way, easements, abandoned roads, Ponds, rivers, creeks, wells , lakes, Joint Driveways, Party Walls, Rights-of-Support, Encroachments, Overhangs, or Projections, Existing Improvements, Water, Electric, Gas, Telephone and Telegraph Pipes, Drains, Wires, Cables, Vaults, Manhole Covers, Catchbasins, Lines, and Poles, Access, Ingress and Egress, Zoning Classification

Residental & Commercial Inspection

Any property, commercial or residential, even undeveloped land or property gifted needs to be inspected to assure you are being protected. The process normally happens after you have a legal contract but also can happen prior if you making the offer. 

 

The inspection process can help determine if the property has unsubtle conditions, conditions required to be modified before closing, conditions that are beyond repair. Home inspections can include but not limited to the current dwelling and adjacent facilities but also the property itself.  

During the inspection process is also encourage to take the extra time to look at ALL the mechanicals with someone certified. Unexpected cost can be buried behind the walls, underground and behind some fresh paint. The sewer system, the connections to the public utilities and the age of everything needs to be considered. 

Some of the findings are expected and are known from the first initial visit. Not every problem is a contract ending issue but an opportunity to address with the seller as a potential negation to repair before closing or adjust the closing price. The value of an experienced real estate broker and team comes into play throughout this process.
